What has to happen before an inherited house can be sold in Texas

Title has to move from the person who passed to whoever now has the right to sell. In Texas that usually happens one of a few ways: probating the will (independent administration is common and relatively quick), a Muniment of Title when there's a will and no debts beyond the mortgage, a Small Estate Affidavit for modest estates without a will, or an Affidavit of Heirship filed in the county deed records when there's no will and the family agrees on who the heirs are.

Which route fits depends on whether there was a will, how much the estate is worth, and how many heirs there are. A probate attorney can tell you in one conversation. If you don't have one, we work with several in Dallas County and can point you to someone who charges a flat fee.
